Terms and Conditions

These are Cotswold Woollen Weavers’ terms and conditions of business. We have been trading for over 30 years in Filkins, so please feel confident and comfortable about ordering from us, and we ask you to agree to these terms and conditions when placing an order. Definitions

"Buyer" means the individual or organisation that buys or agrees to buy the Goods from the Seller.

"Goods" means the articles that the Buyer buys from the seller through the Internet.

"Seller" means Cotswold Woollen Weavers

"Website" means http://www.cotswoldwoollenweavers.co.uk

Conditions

Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

Out of stock products

In most cases the product will be withdrawn from the Website when out of stock. In the eventuality of a product being ordered online that is then found to be out of stock, the Buyer will be given the opportunity to wait until the goods are in stock or cancel his/her order.

Changes to product details

The Seller reserves the right to make changes to pricing and shipping at any time without any due notice to consumers.

Prices and payment

All products prices shown on this website include VAT (at 20% on cost) when bought within the UK, but are nett outside it (which is why the non-EC carriage rates are cheaper.) Payment must be made in full before goods are packed and dispatched.

Packing, Carriage and Deliveries

Details of the Seller’s delivery options and charges relating to specific items and destinations are on the Basket Page. However, in most cases packing and carriage charges are as follows:


To all destinations within the United Kingdom (Eg England, Scotland, Wales)

   Postage & Package on any number of items, and any value of order: £8

To all destinations outside the United Kingdom

   Postage & Package on any number of items, and any value of order: £20

 

Orders will generally be despatched by DHL, and all reasonable efforts will be made to deliver goods within 2 days within the UK, and 3-5 working days anywhere else in the world.

However, the Seller does not accept any liability for any losses, costs, damages or expenses incurred by the buyer or any other third party, arising directly or indirectly from a delivery arriving outside of the expected delivery period.

Please note that in certain circumstances, e.g. a strike affecting the courier, ports or airlines, a delivery may be delayed. The Seller will make every effort to make sure that goods purchased are delivered on time, but cannot take responsibility for circumstances outside of the Seller’s control that result in goods being delayed in transit.

Deliveries will be made to the Buyer’s address specified in the order and the Buyer shall make all reasonable efforts to take delivery of the order. Title and risk in the Goods shall pass to the Buyer upon receipt of the delivery.

Taxes and duties levied in other countries

Non-UK Buyers will be responsible for any duty or taxes that may be levied in their own country. The purchase price paid to the Seller covers the goods bought and postage and packing only.

Currencies

Prices on the website are in GB pounds. The basket and checkout pages also show approximate conversions in USD and Euros. If the purchase is made from abroad you will be charged in the Buyer’s own currency and the banks will perform an exact currency conversion automatically so that the Seller receives GB pounds.

A currency converter is available at http://www.xe.com/ucc as a general guideline only. The bank may debit a slightly different amount.

Cancellation and returns

If the Buyer is unhappy  with any goods purchased from the Seller, he/she may return them at any time up to 10 days after delivery. Please send an email to info@naturalbest.co.uk stating briefly the reason for wanting to return the goods. Once the method of return is agreed, and the goods returned to the Seller, the full purchase price including outward carriage (from Seller to Buyer) will be refunded. The Buyer is responsible for return carriage (from Buyer to Seller.) The goods remain under the Buyer's title until they are received by the Seller. Nothing in this paragraph affects the Buyer’s statutory rights.

Rights of the seller

The Seller reserves the right to adjust the price and specification of any item on the website at its discretion.

The Seller reserves the right to withdraw any goods from the website at any time.

The Seller shall not be liable to anyone for withdrawing any Goods from the website or for refusing to process an order.

The transaction process

In the interests of internet and credit card security, the Seller reserves the right to cancel any sale, even after the Buyer has apparently completed the purchasing process successfully (eg received a confirmation of sale message on the Website and/or via email).

If the Buyer’s payment details are found to be invalid or if the Seller cancels the sale for any reason, the Seller will email the Buyer to confirm the cancellation of the order, and that payment has been declined.

Limitation of liability

Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

Waiver

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Force Majeure

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

Changes to terms and conditions

The Seller shall be entitled to alter these Terms and Conditions at any time. However, this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

Governing law and jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English and Welsh courts.

Intellectual property and right to use

Any Visitor to the Website, whether a buyer or not, acknowledges and agrees that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in Cotswold Woollen Weavers.

The Visitor acknowledges and agrees that the material and content contained within the Website is made available for the Visitor’s personal non-commercial use only.

The Visitor agrees not to (and agrees not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Privacy Policy

Any data submitted via forms on the Website will be held in accordance with the Data Protection Act. No credit card data is held by Cotswold Woollen Weavers.
